These Terms of Service ("Terms") govern your use of the website at lgbtfamilylawservice.com (the "Site") and the 24/7 help line at (855) 218-9853 (the "Help Line"), both operated by The LGBT Family Law Service ("we," "us," or "our"). By accessing the Site or calling the Help Line, you agree to these Terms. If you do not agree, do not use the Site or the Help Line.
1. Description of the service
The LGBT Family Law Service is a free, nationwide referral and information service for LGBTQ individuals and families seeking family law assistance. We connect callers with independent, licensed family law attorneys who handle LGBTQ family law matters — divorce, custody, adoption, parentage, surrogacy, estate planning, name and gender marker changes, and related areas. The Help Line is available 24 hours a day, 7 days a week.
2. We are not a law firm; no legal advice
The LGBT Family Law Service is not a law firm. We do not provide legal advice, legal opinions, legal representation, or any other legal services. Nothing on the Site or said during a call constitutes legal advice. Information on the Site is for general informational purposes only and is not a substitute for advice from a licensed attorney in your jurisdiction.
3. No attorney-client relationship with us
Using the Site, calling the Help Line, sending us a message, or submitting a form does not create an attorney-client relationship with The LGBT Family Law Service. Any attorney-client relationship is formed only with the independent, licensed family law attorney you may choose to retain after a referral. That relationship is governed by the attorney's own engagement agreement and applicable rules of professional conduct.
4. Affiliate / compensation disclosure
We may receive compensation from attorneys in our referral network when we refer a caller to them, when a caller retains them, or under other arrangements. We do not charge you for using the Help Line or the Site, and the compensation we receive does not affect the fees the attorney may charge you. You are never obligated to retain any attorney we refer you to.
5. Eligibility
The Site and Help Line are intended for adults located in the United States. By using the Site or Help Line, you represent that you are at least 18 years old, that you have the legal capacity to enter into these Terms, and that your use complies with all applicable laws.
6. Your conduct
When using the Site or the Help Line, you agree not to:
- Provide false, misleading, or fraudulent information;
- Use the Site or Help Line for any unlawful purpose, or in a way that infringes the rights of others;
- Interfere with, disrupt, or place an unreasonable load on the Site, the Help Line, or any related systems;
- Attempt to gain unauthorized access to any portion of the Site, Help Line, or related systems;
- Harass, threaten, or abuse our staff, our service providers, or attorneys in our network;
- Use any automated means (such as bots or scrapers) to access the Site or Help Line without our prior written permission;
- Use the Site or Help Line to send unsolicited commercial communications or to violate any applicable telemarketing law.
7. Call recording and communications
Calls to the Help Line may be recorded for quality assurance, training, and safety. Where required by law, you will be informed at the start of the call that recording is taking place. By staying on the call, you consent to the recording. If you do not consent, please end the call and contact us by another means (such as our contact form).
By providing us with your phone number or email address, you authorize us — and the attorneys we refer you to — to contact you using that information about your inquiry. You may opt out of marketing communications at any time using the unsubscribe link in our emails or by submitting our contact form.
8. Intellectual property
The Site and its content — including text, graphics, logos, images, the rainbow gavel mark, code, and the arrangement of all of the foregoing — are owned by The LGBT Family Law Service or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You may view and use the Site for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written permission, except as expressly permitted by these Terms or applicable law.
9. Third-party services and links
The Site may include links to third-party websites, services, or resources (for example, the National LGBTQ+ Bar Association or Lambda Legal). We do not control and are not responsible for the content, accuracy, or practices of third-party sites or services. Linking to a third-party site does not imply endorsement.
Attorneys in our referral network are independent third parties. We do not employ them, supervise them, or guarantee their work. Your relationship with any attorney you choose to retain is between you and that attorney.
10. Disclaimers
THE SITE AND HELP LINE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Site or Help Line will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no warranty regarding the accuracy, completeness, or usefulness of any information on the Site or provided by the Help Line. We make no warranty regarding the qualifications, competence, conduct, or outcomes obtained by any attorney in our referral network.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE LGBT FAMILY LAW SERVICE, OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, THE HELP LINE, OR ANY REFERRAL — WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR HELP LINE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify, defend, and hold harmless The LGBT Family Law Service and our officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site or Help Line; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to us.
13. Termination
We may suspend or terminate your access to the Site or Help Line at any time, with or without notice, for any reason, including violation of these Terms. The provisions of these Terms that by their nature should survive termination — including Sections 2, 3, 4, 8, 10, 11, 12, 14, and 16 — will survive.
14. Governing law and dispute resolution
These Terms and any dispute arising out of or relating to them, the Site, or the Help Line are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to any mandatory rights you have under applicable consumer protection laws, you and we agree that any dispute arising out of or relating to these Terms, the Site, or the Help Line will be brought exclusively in the state or federal courts located in Alameda County, California, and you and we consent to the personal jurisdiction and venue of those courts.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will provide additional notice (for example, by posting a notice on the Site). Your continued use of the Site or the Help Line after a change becomes effective constitutes your acceptance of the revised Terms.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
